Position Title: Chief, Air Travel Consumer Protection and Competition Branch
Salary Range: $123,758 – $155,500
Overview of the Office:
This position is located in the Office of the Assistant General Counsel for Aviation Enforcement and Proceedings, Office of the General Counsel, Office of the Secretary (OST), U.S. Department of Transportation. The office is responsible for: (1) enforcing the Department’s aviation economic and civil rights requirements; (2) promoting and enforcing compliance with the Federal antitrust laws; (3) providing legal review and investigative support on initial and continuing air carrier fitness matters; (4) serving as Public Counsel in hearing cases involving fitness or international aviation carrier selection proceedings; and (5) acting as the prosecutor in cases conducted under the Program Fraud Civil Remedies Act to obtain penalties for false statements or false claims made to OST.
The duties of the Chief of the Air Travel Consumer Protection and Competition Branch include: (1) directing the day-to-day operations of the Branch; (2) enforcing the Department’s air travel consumer protection requirements through warning letters or more formal action, such as consent orders or administrative litigation to impose cease and desist provisions and civil penalties; (3) providing agency personnel with sound legal and policy advice concerning the Department’s enforcement activities with respect to the rights of air travelers; and (4) drafting and/or reviewing rulemaking documents dealing with consumer protection and competition issues. Also, from time to time, the Chief assists in other office matters and serves as Acting Deputy or Acting Assistant General Counsel in the absence of the Assistant General Counsel or Deputy Assistant General Counsels.
Among other things, applicants must be citizens of the United States and must hold a J.D. degree from an accredited law school and be a member in good standing in the bar of a State, Territory of the United States, or the District of Columbia.
The position requires strong managerial, leadership, and inter- personal skills. It also requires excellent negotiating, analytical, writing, editing, and oral presentation and advocacy skills. The incumbent should be able to work successfully with individuals from diverse backgrounds and should be able to handle multiple projects and issues simultaneously and in a timely manner. A background in transportation or aviation law, consumer protection rulemaking, enforcement, and/or administrative agency practice is a plus, but is not required. The incumbent is required to have prior experience in consumer protection law.
Position is open to all sources. This is an Excepted Service position. This job will be filled by an alternative hiring process and is not in the competitive civil service. All applicants currently employed by the Federal government must be eligible for a GS 15 position in the office by September 2012. All applicants that are not currently employed by the Federal government must have at least 4 years of prior attorney experience. The applicant selected for this position is subject to a probationary period. Applicants employed in the Federal government will be required to provide a Standard Form 50, Notification of Personnel Action if an offer is extended.
